{"id":352,"date":"2020-02-18T10:57:34","date_gmt":"2020-02-18T16:57:34","guid":{"rendered":"https:\/\/www.insight-safari.com\/?page_id=352"},"modified":"2020-02-18T10:59:42","modified_gmt":"2020-02-18T16:59:42","slug":"ccpa","status":"publish","type":"page","link":"https:\/\/www.insight-safari.com\/index.php\/ccpa\/","title":{"rendered":"California Consumer Privacy Act (CCPA)"},"content":{"rendered":"\n<h2 id=\"wp-block-themeisle-blocks-advanced-heading-e5977768\" class=\"wp-block-themeisle-blocks-advanced-heading wp-block-themeisle-blocks-advanced-heading-e5977768\" style=\"color:#000000;font-style:normal;text-transform:none\">Compliance for the collection, usage,\nprocessing and transfer of personal data in relation to marketing research <\/h2>\n\n\n\n<p>The\nCalifornia Consumer Privacy Act (\u201cCCPA\u201d or the \u201cAct\u201d) went into effect January\n1, 2020. This sweeping legislation creates significant new requirements for\nidentifying, managing, securing, tracking, producing and deleting consumer\nprivacy information. <\/p>\n\n\n\n<p>The\nCCPA takes the position that consumers \u201cown\u201d their privacy information and\nprovides them five general \u201crights\u201d for their personal information. Under the\nAct, California consumers will have the right to request information regarding:\n<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The categories of\npersonal information businesses collect about them (e.g., identifiers such as\ntheir names, Social Security numbers, IP addresses, email addresses, postal\naddresses; purchasing histories; geolocation data, biometric information,\ninternet activity such as web browsing histories; and professional or employment-related\ninformation) <\/li><li>The sources from\nwhich that personal information was collected (e.g., online order histories,\nonline surveys, marketing companies, tracking pixels, cookies, web beacons, or\nrecruiters) <\/li><li>The categories of\npersonal information \u201csold\u201d to third parties** <\/li><li>The categories of\npersonal information disclosed for business purposes <\/li><li>The categories of\nthird parties to whom personal information was sold or disclosed (e.g.,\ntailored advertising partners, affiliates, social media websites, service\nproviders) <\/li><li>The business or\ncommercial purposes for which personal information was collected or sold (e.g.,\nfraud prevention, marketing, improving customer experience) <\/li><li>The\n&#8220;specific pieces&#8221; of personal information collected <\/li><\/ul>\n\n\n\n<p>As\na company who provides services which include interactions with consumers or\ncustomers, we understand the requirements of CCPA and how to handle any\nconsumer requests related to CCPA and personal information (PI). <\/p>\n\n\n\n<p>Definition\n<\/p>\n\n\n\n<p>CCPA\nbroadly defines the term PI (or PII) as \u201cinformation that identifies, relates\nto, describes, is reasonably capable of being associated with, or could\nreasonably be linked, directly or indirectly, with a particular consumer or\nhousehold.\u201d CCPA\u2019s expansive definition of the term PI includes data such as\ninternet protocol (IP) addresses; search and browsing history; call history; as\nwell as inferences drawn from these data elements that could create a profile\nabout a consumer. <\/p>\n\n\n\n<p>More\nspecifically, &#8220;Personal information&#8221; means: <\/p>\n\n\n\n<p>An\nindividual&#8217;s first name or first initial and his or her last name in\ncombination with any one or more of the following data elements, when either\nthe name or the data elements are not encrypted or redacted: <\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Social security\nnumber <\/li><li>Driver&#8217;s license\nnumber or California identification card number <\/li><li>Account number,\ncredit or debit card number, in combination with any required security code,\naccess code, or password that would permit access to an individual&#8217;s financial\naccount <\/li><li>Medical\ninformation <\/li><li>Health insurance\ninformation <\/li><\/ol>\n\n\n\n<p>Ensuring\nData Privacy and Compliance <\/p>\n\n\n\n<p>We\nhave taken the following measures to ensure data privacy and compliance with\nthe California Consumer Privacy Act (CCPA) as well as other privacy\nregulations, such as GDPR. <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>We have conducted\na data protection impact analysis (DPIA) <\/li><li>We have reviewed\nand continue to review the data we hold and our data collection processes <\/li><li>We have updated\nour privacy policies <\/li><li>We have added opt\nout links onto the footer of our websites and included a toll-free number for\ntelephone opt out requests <\/li><li>We have appointed\na Data Protection Officer <\/li><li>We have addressed\nour ability to provide personal data information upon request, the right to be\nforgotten (deletion), and data portability <\/li><li>We have addressed\ndata protection by design and default <\/li><li>We have addressed\nsecure data transfer <\/li><li>We have addressed\nthe issue of risk <\/li><li>We have prepared\na data breach notification process <\/li><li>Robust data\nprotection technology is in place and regularly assessed and updated <\/li><\/ul>\n\n\n\n<p>Data Protection Officers<\/p>\n\n\n\n<p>Ron Zandbergen<br>COO<br>Insight Safari LLC<br>T. 866-587-1546 x 105 <br>ron@insight-safari.com<\/p>\n\n\n\n<p>Contact\nInformation (Insight Safari LLC) <\/p>\n\n\n\n<p>Insight\nSafari consumers can request access to or deletion of their PI, and to\notherwise exercise their CCPA rights, regardless of whether they are a\nCalifornia resident or not.
